Terms of Service

These Terms of Service ("Terms") govern your use of the CAIMY platform at app.caimy.com.au and the CAIMY browser extension (the "Service"), provided by Caimy Pty Ltd ("CAIMY", "we", "us"). By using the Service you ("you", the "Customer") agree to these Terms.

1. The Service

CAIMY is administrative software for licensed Australian education and migration agencies preparing student visa (subclass 500) applications. It reads documents, pre-fills the Department of Home Affairs form, drafts a Genuine Student statement and, through the browser extension, fills the ImmiAccount form. The Service performs clerical tasks only. It does not provide migration, legal or other professional advice, it does not assess eligibility, and it never lodges or submits any application.

2. Your responsibilities

You are solely responsible for:

CAIMY does not guarantee any visa outcome and is not responsible for decisions of the Department of Home Affairs.

3. Accounts

Accounts are created through our onboarding. You are responsible for your account, the users you add, and keeping login credentials secure. You must provide accurate account information and notify us of any unauthorised use.

5. The browser extension

The extension fills fields on your own authorised ImmiAccount session. It is fill-only: it never submits an application and never accesses or stores your government login credentials. You are responsible for reviewing what it fills before lodging.

6. Acceptable use

You must not misuse the Service, attempt to breach its security, use it for any unlawful purpose, upload malicious content, or resell or provide the Service to third parties without our written permission.

7. Intellectual property

CAIMY, the Service and its software are owned by Caimy Pty Ltd. You retain ownership of the data you and your clients upload; you grant us a licence to process it solely to provide the Service, as described in our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we do not warrant that it will be error-free or uninterrupted, that any output is complete or accurate, or that any application will be approved. The Service is not migration or legal advice. Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot be excluded.

9. Limitation of liability

To the extent permitted by law, our total liability arising out of or in connection with the Service is limited, at our option, to re-supplying the Service or refunding the amount you paid for it in the three months before the claim. We are not liable for indirect or consequential loss, loss of profits, or the outcome of any application.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. On termination your access ends; we handle your data in accordance with the Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts.
